Conditions of Sale
Please read these product terms and conditions carefully
as they affect your rights and liabilities under the law and set out the terms
under which whysleep.co.uk makes the products available to you.
Prices
We aim to make the prices payable as clear as possible for items on our web
site. Should an error in pricing be discovered, we will contact you to discuss
the matter before processing and accepting the order. All prices are expressed
inclusive of any VAT payable unless otherwise stated. All prices unless stated
otherwise include delivery within the UK.
Any item listed before it's actual release may have
its price changed before shipping as it is not always possible to fully predict
the price before product launch. If the price is less than we quoted on the
web site you will be charged the new price; if however the price has increased
and we are unable to absorb the difference, we will contact you regarding
your order.
Availability
If for any reason beyond our reasonable control, we are unable to supply a
particular item, we will notify you as soon as possible.
Acceptance
There will be no contract of any kind between you and us unless and until
we actually dispatch the goods to you. At any point up until then, we reserve
the right to decline to supply the goods to you without giving any reason.
At the moment that the goods are dispatched (and not before), a contract will
be made between you and us.
Your order history and status may be checked online
under the My Account area at any time.
Delivery
All items are dispatched to the address specified during the checkout process.
At this time we only accept orders from and ship to the 25 European Union
countries, which include United Kingdom, Austria, Belgium, Cyprus, Czech Republic,
Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy,
Latvia, Lithuania, Luxembourg, Malta, The Netherlands, Poland, Portugal, Slovakia,
Slovenia, Spain, Sweden. Deliveries will be made by Royal Mail or as we see
fit, a courier service.
Orders will either be shipped directly from whysleep.co.uk's
European distribution centre or from an agent working on our behalf. Delivery
schedules and further information can be found under the delivery section
of the Customer Services area.
It is our aim to have all orders fully shipped within
30 (thirty) days of your order, with the exception of pre-release products.
Even with this aim, we shall not be liable for loss occasioned by delay in
delivery arising out of any cause beyond our control.
Cancellation
Orders that have not been dispatched can be cancelled at any time before shipping
by contacting customer services by email.
After the order has been shipped, you have the right
to cancel your order up to 7 (seven) working days after the day following
the delivery, again by contacting customer services by email. All items must
be returned at your cost to us at the address specified in the Customer
Services area under canceling orders. We will refund any monies paid through
the same manner as they where paid within 30 (thirty) days of receiving your
cancellation request, less any shipping charges we original billed for.
If after informing us that you wish to cancel your
order you have not returned the products within 21 (twenty one) days of your
cancellation, we will make a charge in respect of the cost of recovering the
goods. If you do not return the goods or fail to make them available for collection
within 30 days of your notice of cancellation, you will be deemed to have
accepted the goods, at which point a new purchase contract will be made and
you will be charged for your order at the price set out on the web site.
All items returned must be in the same condition that
we dispatched them to you in. Items that are returned that have been opened
or used can not be returned (unless faulty or not as described) as by opening
and using the product you are deemed to have accepted the goods.
Important Information about returns,
- The product must be returned with the original packaging intact and all
safety seals in place.
- whysleep.co.uk regret that we cannot be held responsible for non-delivery
of returned goods so we recommend you use an insured delivery service, e.g.
Special Delivery from the Royal Mail, which is available at Post Offices.
- If an item has been returned for any reason other than a product fault
or a mistake we’ve made, you will be refunded the cost of the goods
but not the return postal charges.
- Your statutory rights are not affected.
- All media sales, which include but not limited to videos, DVDs, audio
tapes, CDs are non-returnable once the seals have been opened.
- In the interest of hygiene, the following items can not be returned unless
faulty or if their safety seal is intact.
- Sex Toys
- Creams and lubricants
- Clothing that is worn next to the skin.
Returns
If for any reason you are not fully satisfied with your purchase, you can
return any item within 7 (seven) working days of receiving the delivery. This
is classed as a cancellation and are processed under our cancellation policy.
For faulty products under guarantee or shipping mistakes
please email customer services of your intention to return a product along
with the reason for the return.You should return the product to us along with
proof of postage costs, which we will refund, to the address indicated by
customer services or the address listed in the Customer Services area.
whysleep.co.uk regret that we
cannot be held responsible for non-delivery of returned goods so we recommend
you use the insured delivery service, Special Delivery from the Royal Mail,
which is available at Post Offices.
Payment
We accept payment from the following methods.
- Secure Online Credit Card Payment
- Cheque or Postal Order
When paying online directly with us, we do not hold
your credit card number for any period longer than it takes to authorise the
payment. This normally takes less than 10 seconds after you have acknowledged
that you wish to proceed with the order. At no time during this period is
your credit card stored in any permanent storage devices. After authorisation,
were we talk directly with the banks over secure channels, we discard your
credit card details. The payment will show as "MyWeb Ltd" on your
credit card bill.
Our liability to you in connection with any order will
not exceed the total price charged for the relevant items.
We accept orders only from Web browsers that permit
communication through Secure Socket Layer (SSL) technology, from browsers
that have a version higher than 4. This means you cannot inadvertently place
an order through an unsecured connection.
General
These Product Terms shall be governed by and construed in accordance with
the laws of England and Wales and any disputes will be decided only by the
English courts.
If any of these Terms & Conditions is held by any
court of competent authority to be unlawful, invalid or unenforceable, in
whole or in part, this will not affect the validity of the remaining Terms
& Conditions which will continue to be valid and enforceable to the fullest
extent permitted by law.
